Colombo Chief Magistrate Thanuja Lakmali ordered the OIC of the Criminal Investigation Department and the OIC of the Maritime Crimes Investigation Division to appear before the court on the 20th of this month to present their case regarding a bail application filed by former Minister of Labour and Foreign Employment Manusha Nanayakkara seeking anticipatory bail as he is about to be arrested.
The court made the order after considering a bail application filed by the former minister through a team of lawyers including President’s Counsel Saliya Peiris.
The lawyers also told the court that the Criminal Investigation Department is preparing to arrest their client in connection with a memorandum of understanding signed by the petitioner in relation to an agricultural and fisheries worker program between Sri Lanka and South Korea and an E8 visa issue.
The lawyers informed the court that the petitioner had signed it as an official act in accordance with the powers he had, but that it was not an act he had personally performed.
The lawyers also requested the court to grant the petitioner anticipatory bail as he had only signed a memorandum of understanding between two governments as a minister and therefore there was no possibility of pursuing a criminal case against him.

හිටපු අමාත්යවරයා ජනාධිපති නීතිඥ සාලිය පීරිස් මහතා ඇතුළු නීතිඥ කණ්ඩායමක් මගින් ගොනු කළ ඇප අයදුම්පතක් සලකා බලමින් අධිකරණයෙන් එසේ නියම කෙරුණා.

පෙත්සම්කරුට හිමිව තිබූ බලතල අනුව නිල කටයුත්තක් ලෙස ඊට අත්සන් තබා ඇති නමුත් එය ඔහු පෞද්ගලිකව සිදුකළ ක්රියාවක් නොවන බවද නීතිඥවරු අධිකරණයට දැනුම්දුන්නා.
ඔහු සිදු කර ඇත්තේ ඇමතිවරයා වශයෙන් රජයන් දෙකක් අතර අවබෝධතා ගිවිසුමක් අත්සන් කිරීම පමණක් බවත් එබැවින් ඔහුට එරෙහිව අපරාධ නඩුවක් පවත්වාගෙන යාමට හැකියාවක් නොමැති බැවින් පෙත්සම්කරුට අපේක්ෂිත ඇපයක් නියම කරන ලෙසට ද නීතිඥවරු අධිකරණයෙන් ඉල්ලා සිටියා.
එම කරුණු සලකා බැලු මහේස්ත්රාත්වරිය ඒ පිළිබඳ ව සලකා බැලීම කල් තැබුවා.
