The Supreme Court has ruled that the decision to award free marks for the three questions that were previously asked in the first paper of the Grade 05 scholarship exam violates fundamental human rights.
Accordingly, the bench has ordered the Commissioner General of Examinations to select an appropriate recommendation from the three recommendations submitted by the experts to resolve this issue and take steps to implement it immediately.
In addition, I.G.S. Premathilaka, who is suspected of being involved in the release of these question papers, must pay three million rupees as compensation to the government.
Similarly, Chaminda Kumara Ilangasinghe must also pay two million rupees as compensation to the government.
Four fundamental rights petitions filed by students and their parents who participated in the examination were heard.
Subsequently, a three-member Supreme Court bench comprising Justices Yasantha Kodagoda, Kumuduni Wickramasinghe and Arjuna Obeysekara announced the verdict.
The petitioners have stated that they are being unfairly affected by the government’s decision to award free marks to all students who appeared for the examination for three questions in the first paper of the Grade 5 Scholarship Examination due to the fact that they were released early.
However, these petitions were submitted seeking a ruling that their fundamental human rights have been violated.

එයට අමතරව මෙම ප්රශ්න පත්ර පිටවීමට සම්බන්ධ බවට සැකකරන පුද්ගලයින් වන අයි.ජී.එස්. ප්රේමතිලක විසින් රුපියල් මිලියන තුනක් වන්දි වශයෙන් රජයට ගෙවිය යුතු වේ.
එමෙන්ම, චමින්ද කුමාර ඉළඟසිංහ විසින් රුපියල් මිලියන දෙකක්ද වන්දි ලෙස රජයට ගෙවිය යුතු වේ.
එම විභාගයට සහභාගී වූ සිසු සිසුවියන් හා ඔවුන්ගේ දෙමව්පියන් විසින් ගොනුකළ මූලික අයිතිවාසිකම් පෙත්සම් හතරක් විභාග කෙරිණ.
අනතුරුව යසන්ත කෝදාගොඩ, කුමුදුනී වික්රමසිංහ සහ අර්ජුන ඔබේසේකර යන මහත්ම මහත්මීන්ගෙන් සමන්විත ත්රිපුද්ගල ශ්රේෂ්ඨාධිකරණ විනිසුරු මඩුල්ල විසින් මෙම තීන්දුව ප්රකාශයට පත් කළේ ය.
5 වසර ශිෂ්යත්ව විභාගයේ පළමු ප්රශ්න පත්රයේ ප්රශ්න තුනක් කලින් පිටවීම හේතුවෙන් එම ප්රශ්න තුන සඳහා එම විභාගයට පෙනී සිටි සියලු සිසු සිසුවියන්ට නිදහස් ලකුණු ලබාදීමට රජය ගෙන තිබෙන තීරණය තුළින් තමන්ට අසාධාරණයක් සිදුවන බව පෙත්සම්කරුවන් සදහන් කර තිබෙනවා.
කෙසේ වෙතත්, ඒ තුළින් සිය මූලික මිනිස් අයිතිවාසිකම් උල්ලංඝනය වී ඇති බවට තීන්දුවක් ලබා දෙන ලෙස ඉල්ලා මෙම පෙත්සම් ඉදිරිපත් කෙරිණ.
