A petition has been filed with the Court of Appeal seeking an order to revoke the position of Minister of Public Security Ananda Wijepala as a Member of Parliament.
The petition was filed by Renuka Perera, the Governing Secretary of the Sri Lanka Podujana Peramuna.
Minister Ananda Wijepala, the Secretary General of Parliament and the Attorney General have been named as the respondents.
The petitioner claims that the President appointed the respondent Ananda Wijepala as the Minister of Public Security on November 18th.
The petition also states that the Sunday Times newspaper published on December 19th reported that Ananda Wijepala had been appointed as the President’s Chief of Staff.
Later, the petitioner states that he made a request under the Right to Information Act in this regard and confirmed that Minister Ananda Wijepala had been appointed as the President’s Chief of Staff.
Arguments in the petition
The petitioner states that Article 91 of the Constitution states that a person engaged in public service is not eligible to sit in Parliament and vote.
Pointing out that the position of Chief of Staff to the President is a public position, the petitioner stated that Minister Ananda Wijepala is not eligible to hold the office of Member of Parliament while holding such a position.
Accordingly, the petitioner has requested the court to rule that Minister Ananda Wijepala is not eligible to hold the office of Member of Parliament in accordance with the Constitution and to issue a decision to disqualify his office.
In addition, the petition also seeks an interim injunction preventing Ananda Wijepala from sitting as a Member of Parliament and voting in Parliament until the petition is heard and a final decision is announced.

පෙත්සම්කරු කියා සිටින්නේ, ජනාධිපතිවරයා විසින් වග උත්තරකාර ආනන්ද විජේපාල, මහජන ආරක්ෂක අමාත්යවරයා ලෙස ඉකුත් නොවැම්බර් මස 18 වන දා පත්කරනු ලැබූ බව ය.
පසුව, ඉකුත් දෙසැම්බර් මස 19 වන දා නිකුත් වූ සන්ඩේ ටයිම්ස් පුවත්පත මගින් ආනන්ද විජේපාල ජනාධිපතිවරයාගේ කාර්ය මණ්ඩල ප්රධානියා වශයෙන් පත් කර තිබෙන බව වාර්තා කර තිබූ බවත් පෙත්සමේ සඳහන් වෙයි.
පසුව, මේ පිළිබඳව තමන් තොරතුරු දැනගැනීමේ පනත යටතේ ඉල්ලීමක් කළ අතර, එහිදී අමාත්ය ආනන්ද විජේපාල ජනාධිපතිවරයාගේ කාර්ය මණ්ඩල ප්රධානියා වශයෙන් පත්කර ඇතැයි තහවුරු කර ගත් බව ද පෙත්සම්කරු සඳහන් කරයි.
පෙත්සමේ තර්ක
ආණ්ඩුක්රම ව්යවස්ථාවේ 91 වන ව්යවස්ථාව යටතේ රාජ්ය සේවයේ නිරත අයෙකු පාර්ලිමේන්තුවේ අසුන් ගැනීමට හා ඡන්දය ප්රකාශ කිරීමට සුදුසුකම් නොලබන බව දක්වා ඇතැයි පෙත්සම්කරු ප්රකාශ කරයි.
ජනාධිපතිවරයාගේ කාර්ය මණ්ඩල ප්රධානියා යනු රාජ්ය තනතුරක් යැයි පෙන්වා දෙන පෙත්සම්කරු, ඒ අනුව එවැනි තනතුරක් දරමින් පාර්ලිමේන්තු මන්ත්රී ධූරයක් දැරීමට අමාත්ය ආනන්ද විජේපාලට සුදුසුකමක් නොමැති බව පැවසීය.
ඒ අනුව, ආණ්ඩුක්රම ව්යවස්ථාව ප්රකාරව ආනන්ද විජේපාල අමාත්යවරයාට පාර්ලිමේන්තු මන්ත්රී ධූරයක් දැරීමට සුදුසුකම් නොමැති බවට තීන්දුකොට ඔහුගේ මන්ත්රී ධූරය බලරහිත කිරීමේ තීන්දුවක් ලබා දෙන ලෙසත් පෙත්සම්කරු අධිකරණයෙන් ඉල්ලා තිබේ.
ඊට අමතරව, මෙම පෙත්සම විභාග කොට අවසන් තීන්දුවක් ප්රකාශයට පත් කරන තුරු ආනන්ද විජේපාල පාර්ලිමේන්තු මන්ත්රීවරයෙකු වශයෙන් අසුන් ගැනීම හා පාර්ලිමේන්තුවේ ඡන්දය ප්රකාශ කිරීම වළක්වාලමින් අතුරු තහනම් නියෝගයක් නිකුත් කරන ලෙසත් පෙත්සමෙන් ඉල්ලා සිටී.
එසේ ම, ආනන්ද විජේපාල මහජන ආරක්ෂක අමාත්ය ධුරයේ කටයුතු කිරීම වළක්වාලන අතුරු තහනම් නියෝගයක් නිකුත් කරන ලෙසත් පෙත්සමෙන් වැඩිදුරටත් ඉල්ලා තිබේ.
