The Court of Appeal on (28) ordered that a petition filed by former President Maithripala Sirisena before the Fort Magistrate’s Court be called for hearing on February 6.
The former President had filed this petition seeking a writ of certiorari to quash the private complaint filed against him before the Fort Magistrate’s Court for failing to take action to prevent a terrorist attack on Easter Sunday despite receiving intelligence information that it was planned.
The petition was called before a bench of judges of the Court of Appeal comprising Dhammika Ganepola and Damith Thotawatte.
The bench of judges also announced that the petition would be heard before a new bench of judges as several judges from the five-member bench that had previously heard the case had been promoted.
Accordingly, the bench ordered that the petition be heard before a new bench on February 6.
The petition filed by former President Maithripala Sirisena had filed the petition with Father Cyril Gamini and a victim of the Easter Sunday attacks as respondents.
The petitioner, the former President, claims that the summons issued by the Fort Magistrate’s Court to appear before the court in connection with a personal complaint filed against him is completely contrary to the law.
Accordingly, former President Maithripala Sirisena has requested the Court of Appeal to declare the manner in which the summons was issued to him illegal and issue an order to invalidate it.
හිටපු ජනාධිපති මෛත්රිපාල සිරිසේන මහතා විසින් කොටුව මහෙස්ත්රාත් අධිකරණය හමුවේ ගොනු කළ පෙත්සමක් විභාගයට ගැනීම සඳහා එළැඹෙන පෙබරවාරි 06 වැනිදා කැඳවන ලෙස අභියාචනාධිකරණය (28) වෙනිදා නියම කළා.
පාස්කු ඉරු දින ත්රස්ත ප්රහාරයක් එල්ලවීමට නියමිත බවට බුද්ධි තොරතුරු ලැබී තිබියදීත් එය වළක්වා ගැනීමට කටයුතු නොකිරීම සම්බන්ධයෙන් තමාට එරෙහිව කොටුව මහෙස්ත්රාත් අධිකරණය හමුවේ ගොනු කර ඇති පෞද්ගලික පැමිණිල්ල බල රහිත කිරීමේ රිට් ආඥාවක් නිකුත් කරන ලෙස ඉල්ලා හිටපු ජනාධිපතිවරයා විසින් මෙම පෙත්සම ගොනු කර තිබුණා.
පෙත්සම ධම්මික ගනේපොල සහ දමිත් තොටවත්ත යන මහත්වරුන්ගෙන් සමන්විත අභියාචනාධිකරණ විනිසුරු මඩුල්ල ඉදිරියේ කැඳවනු ලැබුවා.
මීට පෙර මෙම නඩුව විභාග කළ පංච පුද්ගල විනිසුරු මඩුල්ලේ විනිසුරුවරුන් කිහිප දෙනෙකු උසස් වීම් ලබා තිබීම හේතුවෙන් මෙම පෙත්සම නව විනිසුරු මඩුල්ලක් ඉදිරියේ විභාගයට ගන්නා බවත් මෙහිදී විනිසුරු මඩුල්ල විසින් නිවේදනය කළා.
ඒ අනුව, අදාළ පෙත්සම විභාගය සඳහා පෙබරවාරි මස 6 වන දා නව විනිසුරු මඩුල්ලක් ඉදිරියේ කැඳවන බවත් විනිසුරු මඩුල්ල නියෝග කළා.
හිටපු ජනාධිපති මෛත්රීපාල සිරිසේන මහතා විසින් ගොණු කර තිබූ මෙම පෙත්සමේ වග උත්තරකරුවන් ලෙස සිරිල් ගාමිණී පියතුමා සහ පාස්කු ප්රහාරයෙන් වින්දිතයකු බවට පත් වූ පුද්ගලයෙකු විසින් මෙම පෙත්සම මගින් ඉදිරිපත් කර තිබුණා.
පෙත්සම්කාර හිටපු ජනාධිපතිවරයා කියා සිටින්නේ තමන්ට එරෙහිව ඉදිරිපත් කර තිබෙන පෞද්ගලික පැමිණිල්ලකට අදාළව අධිකරණය හමුවේ පෙනී සිටින ලෙස දන්වා කොටුව මහෙස්ත්රාත් අධිකරණය විසින් නිකුත් කරනු ලැබූ සිතාසිය සම්පූර්ණයෙන්ම නීතියට පටහැනි බවයි.
ඒ අනුව, තමන්ට සිතාසි නිකුත් කර තිබෙන ආකාරය නීති විරෝධී යැයි තීන්දු කර එය බල රහිත කිරීමේ නියෝගයක් නිකුත් කරන ලෙසත් හිටපු ජනාධිපති මෛත්රිපාල සිරිසේන මහතා අභියාචනාධිකරණයෙන් ඉල්ලා තිබෙනවා.
